Truck Driver Awarded $200,000 and Reinstatement Following Coercion Case

August 04, 2016

A truck driver for Neier, Inc. was awarded a large sum of money for back pay, attorney’s fees, as well as punitive and compensatory damages after he was wrongfully fired for refusing to accept a load that would have caused him to violate federal hours of service limits. A driver has the right to refuse a load if it will cause him to violate safety rules or if it will threaten safety, like requiring him to operate while tired and inattentive. RSA supports the federal government’s efforts to ensure that truck drivers are not forced to drive as this creates an industry culture that promotes unsafe driving behaviors.
